Digital Millennium Copyright Act Policy

ATP Digital Millennium Copyright Act (“DMCA”) Policy (“DMCA Policy”)

 

Advanced Training Philosophies (“ATP”) respects the intellectual property rights of others and expects users to do the same. In accordance with the DMCA, this DMCA Policy is provided to inform subscribers, account holders and users of ATP’s website ("www.trainatp.com") of ATP’s policy with respect to notification and removal procedures with respect to alleged infringing material.

 

1. Legal Notice: Copyright Infringement Claim

 

If a person wishes to file a claim of infringement with ATP, the person shall provide notice to ATP’s designated agent in accordance ATP’s Legal Notice as follows:

 

1.1    A person shall direct any copyright infringement claims to ATP’s designated agent, consistent with section 512 of the DMCA (17 U.S.C. Section 512). The designated agent to receive notification of claimed infringement, is available in the following manner:

1.2    All copyright infringement claims must be in writing and shall include the following information:

 

1.2.1        A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

1.2.2        Identification of the copyright work claimed to have been infringed, or, if multiple copyrighted works at a single website are covered by a single notification, a representative list of such works at that website.

1.2.3        Identification of the material that is claimed to be infringing or to be disabled, and information reasonably sufficient to permit ATP to locate the material.

1.2.4        Information reasonably sufficient to permit ATP to contact the complaining party, including address, telephone number, and e-mail address.

1.2.5        A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

1.2.6        A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

 

Failure to include the required information in the Legal Notice in accordance with the procedures set forth may cause ATP to delay, cancel, or be unable to process the Legal Notice.

 

Upon receipt of a proper Legal Notice, ATP will use ATP’s reasonable efforts to expeditiously remove, or disable access to, the alleged infringing content that is the subject of the Legal Notice.
